Facts of the Case
The petitioner, a proprietorship concern, was involved in the business of manufacturing and supply of goods. During the course of the business, the petitioner had obtained a loan from HDFC Bank. Due to financial distress, the petitioner was unable to repay the loan amount and, therefore, the bank filed an application for the recovery of dues before the Debt Recovery Tribunal (DRT). Further, the petitioner’s factory premises were sealed by the bank. The petitioner approached the Delhi High Court and filed a writ petition to de-seal the factory premises and release the withheld amount from the loan. The petitioner also requested the court to issue directions to the GST Department to reconsider the penalty and interest imposed vide the order dated 29-04-2024. During the hearing, the petitioner requested to withdraw the writ petition with liberty to initiate appropriate proceedings before the appropriate forum in accordance with the law.
High Court Held
The Delhi High Court held that the petitioner sought leave to withdraw the writ petition with liberty to approach the appropriate forum for further proceedings. Consequently, the petitioner’s leave to withdraw the writ petition was granted and dismissed accordingly. Further, the petitioner was also allowed to initiate proceedings before the appropriate forum in line with the law.
