PIL Filed in HC Challenging Denial of Sec. 87A Rebate Under New Tax Regime If Income Taxed at Special Tax Rates

A Public Interest Litigation (PIL) has been filed before the Gujarat High Court challenging the denial of the rebate under section 87A of the Income Tax Act, 1961, on the income attracting special rates of tax. The petitioner contended that the rebate under section 87A was denied to the eligible assessees on any income chargeable to tax at special rates under the new regime. This action of the Income-tax Dept. was in clear violation of the law.
The petition was filed in the interest of the class of the assessees, residing all over India, who are eligible to obtain the benefit of the rebate under section 87A.
