SEBI Releases Format of ‘Annual Secretarial Compliance Report for REITs

As per Regulation 26D of SEBI (Real Estate Investment Trusts) Regulations, 2014 the manager of REIT is required to submit a secretarial compliance report given by a practicing company secretary to the stock exchanges, within 60 days from the end of each financial year. The secretarial compliance report shall be annexed with the annual report of the REIT.
Accordingly, the Manager of the REIT, on an annual basis, shall appoint a practicing company secretary to examine the compliance of all applicable SEBI Regulations, circulars and guidelines issued thereunder. Subsequently, the practicing company secretary shall submit a report to the manager of the REIT.
Now, SEBI has specified the format for the annual secretarial compliance report. The annual secretarial compliance report shall also be made part of the annual report of the REIT. Further, this circular shall come into force with effect from the financial year 2023-24 onwards.
