An expert committee was mandated to examine the scope of use of mediation in respect of processes under the IBC, 2016 and submit its recommendations. In this report, the Committee presents its recommendations on the likely framework for introducing mediation as a complementary mechanism for resolving disputes. In its formal introduction, the Committee has cautiously aimed to balance the Code’s core objectives of time-bound reorganization and value maximisation.
